An Andover woman who said she fell on a stairway at the Caffe Nero at 77 Main Street in Andover filed a lawsuit Tuesday seeking damages in Essex County Superior Court for permanent injuries and mental anguish as the result of a fall in June 2020.

In her complaint, Beatrice Walsh said she was asked to exit through a rear door on June 8, 2020 as part of COVID precautions and fell on an “unsafe exit stairway and landing.” The complaint says the store failed to keep the exit free of defects or warn her of unsafe conditions, including the lack of a railing on the stairway.

Walsh “was seriously injured requiring medical attention,” the complaint said. “The effects of the Plaintiff’s injuries are permanent in nature; additionally, she suffered great pain and mental anguish and will continue to suffer great pain and mental anguish in the future.”

A spokesperson for Caffe Nero, which operates 36 coffee houses in eastern Massachusetts, was not immediately available for comment Wednesday morning.
